Gross domestic product (GDP) is finally growing again, rising by 2.2 percent in the third quarter of 2009, with an early estimate of 5.7 percent for the fourth. The fourth quarter number will probably be revised down, but it will still likely mark the fastest growth since 2003. The unemployment rate, after a nosedive, leveled off in the last few months of the year, and the stock market has regained 40 percent of its value after a March 2009 low. Four of the five largest bailed-out banks have either repaid the government or received permission from the Treasury Department to do so in the near future. Inflation slowed to a standstill in November after 10 months of increasing consumer prices. Construction of new homes and apartments increased in 2009 from 2008 levels, the first annual growth in housing starts since 2005. “The Recovery Act has created jobs and spurred growths,” President Barack Obama said in a December speech trumpeting the success of his economic policies. “We are in a very different place today than we were a year ago.” Lawrence Summers, director of the White House National Economic Council, concurs. “Everybody agrees that the recession is over,” Summers said that same month on ABCs This Week. But a closer look reveals those appealing numbers sit on a dangerously shaky foundation. Economic growth in 2009 was largely dependent on a historic level of government spending that even the president acknowledges is unsustainable in the long term. The root problem of mortgage delinquencies has yet to be worked out. Bank lending is sparse amid ongoing uncertainties surrounding regulatory reform. As a result, manufacturers and small businesses continue to struggle with limited credit. All that translates into historic job losses and a bleak outlook for meaningful growth in 2010 and 2011. Worst of all, many of the core problems in the housing, banking, manufacturing, and service sectors are being perpetuated and exacerbated by the very federal programs the president credits with jump-starting economic growth. Instead of confronting the roots of the crisis head on, as Obama has repeatedly boasted of doing, his administration and the Democratic Congress have kicked the can down the road, postponing the day of reckoning for real estate, the auto industry, and the toxic mortgage-backed securities that were at the heart of the economic meltdown. These unsolved problems will keep looming over the economy until theyre finally addressed.

IRVING, Texas — Excentus Corporation announced that it filed a lawsuit yesterday against
The Kroger Co. in the United States District Court for the Northern
District of Texas in Dallas, alleging willful patent infringement. The
lawsuit seeks injunctive and equitable relief along with unspecified
damages.
“Kroger contacted us in October 2008 immediately following our
acquisition of the AutoGas patents. They wanted to resume patent
licensing discussions which had occurred with AutoGas prior to Excentus
closing the transaction to purchase the AutoGas patents,” said Dickson

to reach a mutual accord with Kroger last year related to our patents
and obliged their request for a time to resolve future plans for the

by Kroger in Safeway’s markets. We believe these efforts were deliberate

MIAMI — Toyota owners claiming that massive safety recalls are causing the value of their vehicles to plummet have filed at least 89 class-action lawsuits that could cost the Japanese auto giant $3 billion or more, according to an Associated Press review of cases, legal precedent and interviews with experts. Such class-action lawsuits “are more scary for Toyota than the cases where people actually got injured,” said Tom Baker, a University of Pennsylvania law professor. “A super-big injury case would be $20 million. But you could have millions of individual car owners who could (each) be owed $1,000. If I were Toyota, Id be more worried about those cases.” As Toyota continues to deal with the recalls and wavering public confidence in its vehicle safety, its biggest financial fight may be in the courtroom. A key decision could come at a March 25 hearing in San Diego, where a panel of federal judges will consider whether to consolidate the mushrooming cases into a single jurisdiction. After that, a judge will decide whether all claims filed by Toyota owners nationwide can be combined in a single legal action — known as “certifying a class” — and whether the claims have enough merit to move toward either trial or settlement.

Guide, which details the guidelines for implementing FireWire (IEEE

Association website, includes references to normative specifications as
well as full reference designs that can be used as is or — with the

WEST VALLEY CITY — A man allegedly found everything he needed to commit a crime in Walmart, including burglary tools, according to police. Police say the man entered Walmart, 3180 S. 5600 West, about 2:30 a.m. Friday. The man first went to the hardware section, where he got a crowbar, said West Valley Police Capt. Tom McLachlan. The man next walked to the electronics section, where he allegedly used the crowbar to pry open a display case and take several iPods and Nintendo DS game systems, McLachlan said. The man loaded the items into a shopping cart and headed for the door. The man loaded some of the items into a car, left some of the merchandise in the cart and drove off. Witnesses were able to a get a license plate number, but it was registered to a vehicle that was listed as stolen, McLachlan said.

New Unit for Patients and Healthy Volunteers in London
RESEARCH TRIANGLE PARK, N.C. — Quintiles today announced the opening of its expanded research facility
in London, UK, increasing its Phase I capacity and extending its ability
to drive progress in translational medicine.
With capacity for 35 patients and healthy volunteers, the extension
brings the total number of Phase I beds in London to 105 and globally to

Five days before exercise, subjects took about 20 grams of creatine and 84 grams of glucose or a placebo. Fourteen days later, they took about 7 grams of creatine and 28 grams of glucose or a placebo. The effects of creatine were dramatic: a 21% greater recovery of strength and 84% less muscle damage compared to the placebo group. This study underscores the importance of daily creatine supplementation, especially on “off” days, to accelerate recovery from intense weight training.

“Canadas renewed support builds on the significant results being achieved in Burmas border areas. Over the past five years, CIDA-funded health care initiatives have treated nearly one million cases of malaria, acute respiratory infections, tuberculosis, and severe malnutrition, provided food aid to approximately 145,000 refugees, and health care services to approximately 500,000 refugees,” said Minister Oda. “These results, along with support for community-based organizations working on human rights and environmental issues, demonstrate how Canadas assistance is helping those in need.”
“Canada, through this support, is focusing on meeting the needs of people in the border areas,” said Ms. Block. “This funding will contribute to building capacity within the Burmese population, while ensuring that basic services, such as health care and food are provided to both refugees and surrounding communities.”
The renewed funding amounts to $15.9 million over five years, and builds on CIDAs $12.4 million contribution for assistance in the region provided over the previous five years. CIDA is continuing to provide assistance in the region through Inter Pares Canada, a Canadian humanitarian organization, which supports numerous organizations, including the Thailand-Burma Border Consortium and the Mae Tao Clinic.
The company said that it has also removed the software from its site and is actively working with CERT and officials from the US Government to determine how the trojan came to be associated with their software. The alert only applies to Windows software made available by Energizer to monitor the two named products charging status. An Apple Mac version of the software is unaffected. Users who may have downloaded and installed the Windows software are advised to uninstall the software and to manually remove a file, Arucer.dll, which may exist in the Windows system32 directory even after the software has been uninstalled. Arucer.dll contains a backdoor trojan that allows a remote user to access an infected computer and assume control with the security rights of the logged on users. This may include listing files and directories, adding or deleting files, downloading files, running applications and installing system processes. When the software supplied by Energizer is installed, Arucer.dll also is installed and set to run automatically at system startup. The infected computer may need to be restarted manually after uninstalling the Energiser software before the file Arucer.dll can be deleted.

Wireless Capacity With Fewer Access Points
SUNNYVALE, Calif. — Aruba Networks, Inc. (NASDAQ: ARUN), a global leader in 802.11n wireless
LANs and secure mobility solutions, today announced that Tulsa Public
Schools (TPS) – the second largest school district in Oklahoma – has
deployed an adaptive wireless network across its schools using fewer
access points, and achieving far better capacity, than competing
alternatives. The 173-square-mile school district serves roughly 42,000
students from 59 elementary schools, sixteen middle schools, nine high
schools, and six special schools.
The District’s legacy wireless network included more than 150 Cisco
autonomous access points. As wireless usage grew and security
requirement became more stringent, the legacy system proved too
difficult to manage and too expensive to expand. Wireless performance
was also an issue; as the density of wireless users increased, network
performance fell.
To address these issues TPS surveyed the market to find a replacement
solution that could scale to support more than 1,000 access points
spread across 90 schools, was centrally managed, and could support high
densities of users simultaneously accessing the network. In addition to
considering the incumbent vendor, and based on recommendations from
other school districts, TPS included Aruba in a technical bake-off from
which a single vendor would be selected.

This covers the description and explanation of different trance states, the construction of reality through hypnosis, and the special relationship between client and therapist. In addition, it discusses me basics of Ericksonian hypnotherapy, the nature of suggestion, and the concept of suggestibility. The contradictions for the use of stage-hypnosis are also given appropriate attention. Finally, there is discussion regarding die use of humor and provocation in treatment. The second part describes various methods of creating the hypnotic state. This is followed by a third section describing the use of therapeutic stories or fairy tales, age regression, hypnoanalysis, and self-hypnosis. The fourth part is dedicated to behavioral disorders and illustrates treatments for addictions, adiposity, sexual disorders, sleeping disorders, and stress. There is, however, a population of patients in whom the outcome of therapy and its permanency can be relatively immediately determined. I have assisted with hypnotherapy for 36 patients undergoing a variety of major surgical interventions and have had essentially complete success in all but one. Not only was the surgery completed without significant discomfort, but the amount of bleeding, and the duration of the hospital stay, was appreciably reduced. These procedures have ranged from breast biopsies to hysterectomies, caesarian sections, and even bilateral jaw resection with bilateral coronoidectomies. The latter procedure lasted 4 Vi hours. Naturally, these patients were well motivated to succeed and differed from the customary mix of hypnotherapy patients. All were very pleased with their accomplishment. In regards to survey instruments attempting to evaluate the success or failure of therapy I have attempted to utilize them in the past, particularly in regard to smoking cessation, and have been skeptical of their reliability. I find that patients are reluctant to report failure of the intervention lest they hurt the feelings of the therapist or his or her reputation. On the other hand close relatives or fellow employees are less reluctant to reveal the truth and I have found it prudent to arrange to make private inquiry of them as well. I would have preferred to obtain urinary cotinine levels, to prove abstinence, on all patients but this was not practical. Nevertheless, my success rate was approximately 45% permanent cessation of smoking at one year utilizing as many methods to validate results as possible. Lastly let me point out that there are varying degrees of success, any of which can be meaningful to the client I have worked with chemotherapy patients who although they were not completely able to prevent vomiting after receiving emetogenic therapy were well pleased by not having to feel as if “all of their insides were about to come out.” I second the suggestion that valid studies be undertaken to evaluate the true results of our hypnotherapeutic interventions, but I also suggest that we not throw the baby out with the bath water..

But, says hypnotherapist Karen Riley, there really is a way to give birth painlessly. She was so inspired by her experiences that she is now training to be a hypnotherapist herself in order to help other women. Karen, an applied biology graduate and member of the British Society of Clinical Hypnosis, specialises in working with women who are having difficulty conceiving and couples who want to learn techniques to assist a natural birth. She is the UK director of the HypnoFertility Foundation, which originated in the US, and leads workshops for other therapists. I was a skinny kid who had a rough childhood. Health and fitness–more specifically bodybuilding–have been important outlets for me in handling the many things Ive been through in my life. Although I did some weight training as a kid, it was when I became a U.S. Marine Corps Body Bearer that I was “bitten by the bodybuilding bug.” Unfortunately, over the next several years, I spent a lot of time overseas, but it didnt stop me from continuing to hang on to ray dream of becoming a bodybuilder, which came to fruition in 2009. I set my sights on competing as a heavyweight in the 2009 All Forces National Military Bodybuilding Championships on October 10, in Tampa, Florida. I connected with Tim Gardner and joined his team, Team Body*Tech, based out of Tampa. At the time, I was in Iraq working as a contractor, so we communicated on a weekly basis via phone and e-mail. When I returned to the States, we jumped into precontest mode. I was very motivated, because so many people over the years said that I didnt have what it takes. Although I didnt carry the level of mass I needed for my height, I felt my conditioning would make up for some of that. NEW YORK — Island Capital Group LLC (“Island Capital”), a private real estate
oriented merchant banking firm controlled by Andrew L. Farkas, and
Centerline Holding Company (“Centerline”) announced today that through
its affiliate C-III Capital Partners (“C-III”), Island had acquired 100%
of Centerline’s institutional real estate debt fund management and
commercial mortgage loan servicing businesses. This transaction
immediately makes the newly created private company one of the largest
special servicers of CMBS in the United States, as it is presently the
named special servicer for approximately $110 billion of loans in 81
CMBS securitizations.
In connection with the acquisition, Island Capital along with Centerline
also announced that Island had completed a total restructuring of
Centerline’s financial structure and core business operations by
eliminating approximately $1.6 billion of debt, contingent liabilities
and preferred equity, providing a much needed injection of equity and
liquidity and permitting the company to emerge as one of the healthiest
and now most stable companies in its industry. Island Capital affiliates
provided in excess of $100 million of new cash equity in connection with
the acquisition and restructuring, and C-III will also own approximately
40% of Centerline, which will remain as a public company.
Subsidiaries of Anubis Advisors, which is a wholly-owned subsidiary of
Island Capital, have been retained as the exclusive external managers
for C-III and Centerline. In such capacity, Anubis will provide
strategic planning, corporate management, restructuring, MA and other
financial services to both companies.
Island Capital’s strategy in acquiring the CMBS fund management and real
estate loan servicing businesses from Centerline is all but identical to
the strategy successfully deployed in connection with the creation and
building of Insignia Financial Group, Inc. Insignia, founded by Mr.
Farkas in 1990, consolidated much of the then distressed real estate
syndication industry, ultimately growing to become one of the largest
owners and operators of real estate in the world, including 350,000
units of multi-family residential housing and in excess of 250 million
square feet of office, retail and industrial space. Insignia’s growth
was a function of the aggregation, restructuring and management of
complex real estate oriented equity derivatives. Mr. Farkas, now
Chairman and CEO of Island Capital, said “The creation of C-III
represents the adaptation and implementation of the Insignia strategic
and operating model to the present environment. Back in 1990 we started
acquiring real estate oriented equity derivatives and building a
property and asset management business to service the assets controlled
by the derivatives. With C-III we are seeking to acquire real estate
oriented debt derivatives and to build special servicing and ancillary
businesses to manage those.”
C-III will operate as special servicer for CMBS through its wholly-owned
subsidiary Centerline Servicing (which will continue to operate under
that name during a transition period), which is currently the named
special servicer for approximately $110 billion of loan in 81 CMBS
securitizations. Other C-III subsidiaries also control real estate debt
investments that have a face value of approximately $3.1 billion. Under
Anubis’s management, C-III’s intention is to integrate a principal
capital deployment and MA strategy within its operations to acquire
incremental CMBS, CMBS fund managers and other servicing operations.
C-III also intends to pursue institutional third-party servicing
relationships and to expand into business lines complementary to those
in which it presently operates.

West Yorkshires new staffing model was only introduced in January 2010 but should generate an extra pounds 4m in a full year. Clr Peter Harrand, who chairs the authoritys Finance and Resources Committee, stressed that the figures, though impressive, only recognised ongoing savings. If one-off savings were added, West Yorkshires efficiencies would top pounds 20m over the five-year period.

James Camerons groundbreaking science-fiction/fantasy “Avatar” is now the biggest film of all time. A little film that made about $700 million less than it did at the box office put a hurting on both Cameron and his mega-blockbuster Sunday night, though. to the leading hosted cross-media publishing platform for e-commerce and
multi-channel marketing companies. The Adobe® Scene7® platform has been
expanded to further automate the production, management, and delivery of
dynamic creative media by providing businesses tighter desktop
integration as well as unique editing and template-based production
capabilities including new user-facing real-time authoring and Web
preview.
This major Scene7 platform update includes a new AIR desktop application
that mirrors the Web-based publishing platform to further streamline
asset management with easy drag and drop upload of files and folders
from the desktop and connected network resources. In addition, the
platform has support for Adobe XMP metadata standards, which allows
users to efficiently administer, browse/filter, and search for assets.
Also, rules-based batch automation of multi-media sets now eliminates
the need for custom scripts or technical support for non-technical users.

personalized experiences with the same or fewer creative and technical
resources, making automation and cost-savings critical components of

addition, the update supports the design, delivery and Web preview of
print templates that dynamically flow text within and across pages
including inline variables. This template enhancement enables a broader
range of multi-page, text-intensive personalized publications.
NEW YORK — Dailymotion and Warner Music Group today announced a new
partnership to offer music videos via Dailymotion’s website in the U.S.,
Europe and North Africa. Visitors will be given unlimited, on-demand,
ad-supported access to thousands of music videos, concerts and
interviews from Warner Music’s roster of local and international acts.
Under the terms of the agreement, registered users will be able to
create and share video playlists. The first videos are due to be
available within a month.
Outside the U.S., Warner Music and Dailymotion will collaborate on
the sale of targeted advertising and approved sponsorships embedded in
the video experience, with Warner Music managing these sales inside the
U.S. Warner Music will also have access to the editorial sections
surrounding the videos, providing its roster of artists with additional
promotional opportunities.

Dailymotion has almost doubled its global and U.S. audience in the
past year while vastly expanding its library of premium and independent

The online ad market is growing fast. According to BIA/Kelsey, a research firm specializing in local media based in Chantilly, VA, the local online ad market is expected to rise to $17.5 billion in the US in 2010, up from $2.8 billion in 2005. And online coupons are a similarly increasing in popularity, particularly in this economy. The coupon aggregator RetailMeNot, reports that consumers have saved over $52 million online between April and December 2009.
